These Terms of Service (“Terms”) govern your use of the Secretcrush website, apps and related services. Please read them carefully. Where the Terms use “we,” “us” or “our,” they refer to Secretcrush. Where they use “you” or “your,” they refer to the person accessing the Service.
1. Acceptance of Terms
By accessing or using Secretcrush at secretcrush-ai.com (the “Service”), you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, please do not use Secretcrush. Continued use of the Service after any update constitutes acceptance of the revised Terms.
2. Eligibility and Age
Secretcrush is intended solely for adults. You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher. By creating an account you confirm that you meet this requirement and that you are legally capable of entering into a binding agreement.
3. Account Registration
To use certain features of Secretcrush, you must create an account with accurate, current information. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify Secretcrush immediately of any unauthorised use.
4. Nature of the Service
Secretcrush is an AI-powered companion platform. The characters, personalities, images and messages generated by the Service are fictional and produced by artificial intelligence. Secretcrush companions are not real people and do not represent real individuals.
5. Acceptable Use
You agree not to use Secretcrush for unlawful, harmful, harassing, defamatory, discriminatory, hateful or infringing purposes. You will not attempt to reverse-engineer, disrupt, overload or exploit the Service, its systems or its models.
6. Prohibited Content
You may not use Secretcrush to generate, request or share content depicting minors in a sexual context, non-consensual acts, real identifiable people without consent, or content that violates applicable law. Violations may result in immediate termination and reporting to authorities.
7. User-Generated Content
Any messages, prompts, images or feedback you submit to Secretcrush (“User Content”) remain yours. You grant Secretcrush a worldwide, non-exclusive, royalty-free licence to store, process and display your User Content solely to operate, maintain and improve the Service.
8. AI-Generated Content
Outputs produced by Secretcrush — including text, images and voice — are provided as-is. You may use them for personal, non-commercial purposes. Secretcrush does not guarantee the accuracy, appropriateness or reliability of any AI output.
9. Subscriptions and Billing
Certain features of Secretcrush require a paid subscription. Prices, billing cycles and features are disclosed at the point of purchase. Subscriptions renew automatically until cancelled through your account settings.
10. Free Trials
Secretcrush may offer free trials at its discretion. If you do not cancel before the trial ends, your paid subscription begins automatically. Trial availability may vary by region and account history.
11. Refunds
Except where required by law, subscription fees are non-refundable. If you believe you were charged in error, please contact support at support@secretcrush-ai.com within 14 days of the charge.
12. Cancellation
You may cancel your Secretcrush subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that period ends.
13. Intellectual Property
All Secretcrush trademarks, branding, software, designs, model personas and interfaces are the exclusive property of Secretcrush or its licensors. You may not copy, distribute, modify or create derivative works from them without written permission.
14. Feedback
If you send feedback, ideas or suggestions to Secretcrush, you grant us the right to use them without restriction and without obligation to compensate you.
15. Third-Party Services
Secretcrush may link to or integrate with third-party services. Secretcrush is not responsible for the practices, availability or content of any third-party service, and your use of them is governed by their own terms.
16. Availability and Changes
Secretcrush strives for high availability but does not guarantee uninterrupted service. Features, models and pricing may be added, changed or removed at any time. Where changes materially affect paid subscribers, Secretcrush will provide reasonable notice.
17. Suspension and Termination
Secretcrush may suspend or terminate accounts that violate these Terms, harm the Service or other members, or where required by law. You may also close your account at any time from your account settings.
18. Data Retention on Termination
Upon termination, Secretcrush may delete or anonymise your account data in line with our Privacy Policy. Some records may be retained where required by law or for legitimate business purposes such as fraud prevention.
19. Disclaimers
Secretcrush is provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, Secretcrush disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
20. Limitation of Liability
To the maximum extent permitted by law, Secretcrush and its affiliates will not be liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, revenues, data or opportunities arising from your use of the Service.
21. Indemnification
You agree to defend, indemnify and hold harmless Secretcrush, its officers, employees and partners from any claims, damages or expenses arising from your use of the Service, your User Content or your breach of these Terms.
22. Governing Law
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Where mandatory local consumer laws grant you stronger rights, those rights are not limited by this section.
23. Dispute Resolution
Before starting formal legal proceedings, you agree to contact Secretcrush at legal@secretcrush-ai.com to seek an informal resolution. If a dispute cannot be resolved informally, it will be brought before the competent courts of Amsterdam.
24. Force Majeure
Secretcrush is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, network outages, government actions, cyberattacks or infrastructure failures at upstream providers.
25. Modifications to the Terms
Secretcrush may update these Terms at any time. Material changes will be communicated via email or in-product notice. Continued use of the Service after an update constitutes acceptance of the revised Terms.
26. Entire Agreement
These Terms, together with the Secretcrush Privacy Policy and any additional terms you agree to for specific features, constitute the entire agreement between you and Secretcrush regarding the Service.
27. Severability
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary.
28. No Waiver
Failure by Secretcrush to enforce any right or provision of these Terms is not a waiver of that right or provision.
